1. Acceptance of Terms

By downloading, installing, or using the TrustNear mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

To use TrustNear, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

3. Account Registration

3.1 Account Creation

• You must register using a valid phone number
• You must verify your phone number through OTP (One-Time Password)
• You must choose to register as either a "Customer" or "Service Provider"
• You may maintain only one account per phone number

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account
• You must notify us immediately of any unauthorized access
• We are not liable for losses resulting from unauthorized access due to your negligence

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• Engage in fraudulent or illegal activities
• Receive consistently poor reviews (below 2.0 stars)
• Fail to respond to service requests repeatedly
• We receive valid complaints about your conduct

4. User Roles and Responsibilities

4.1 Customer Responsibilities

• Provide accurate and complete service request details
• Set realistic budgets for services
• Respond to provider inquiries in a timely manner
• Pay agreed-upon amounts for completed services
• Provide honest and fair reviews
• Treat service providers with respect

4.2 Service Provider Responsibilities

• Provide accurate information about your skills, experience, and service area
• Respond to service requests professionally and promptly
• Complete services as agreed with the customer
• Maintain professional conduct at all times
• Comply with all applicable licenses and certifications
• Maintain accurate availability status
• Honor accepted bids and quoted prices

5. Service Requests and Bidding

5.1 Posting Requests

• Customers may post service requests with descriptions and budget ranges
• Requests are visible to providers in your geographic area
• You may cancel requests before accepting a bid

5.2 Bidding Process

• Providers may submit bids on customer requests
• Bids are binding offers to perform services at the quoted price
• Customers may accept, reject, or ignore bids
• Accepting a bid creates a service agreement between customer and provider

6. Payments and Fees

6.1 Service Payments

• Payment terms are agreed directly between customer and provider
• TrustNear does not process payments (unless explicitly stated)
• Disputes over payment should be resolved between the parties

6.2 Platform Fees

• TrustNear may charge service providers a commission or subscription fee
• Fee structures will be clearly communicated to providers
• Customers use the platform free of charge

7. Reviews and Ratings

7.1 Posting Reviews

• Only users who have completed a service transaction may post reviews
• Reviews must be honest and based on actual experience
• Reviews cannot be edited after submission (only deleted within 24 hours)

8. In-App Communication

8.1 Chat Feature

• Users may communicate through the in-app chat system
• Chat messages are stored securely and accessible to both parties
• Either party may delete chat messages for themselves

8.2 Communication Guidelines

• Keep communications professional and respectful
• Do not share sensitive personal information (bank details, passwords)
• Do not use chat for harassment, spam, or illegal activities

9. Location Services

9.1 Location Collection

• TrustNear collects approximate location (city/area level) for service matching
• Location is used to connect you with nearby users
• You may disable location services, but this will limit app functionality

9.2 Location Accuracy

Location data is approximate and used for matching purposes only. We do not track your real-time movements or share precise GPS coordinates with other users.

10. Prohibited Conduct

You agree NOT to:

• Use the App for any illegal purpose
• Impersonate another person or provide false information
• Harass, abuse, or harm another person
• Transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to the App or other users' accounts
• Scrape, crawl, or spider any portion of the App
• Use the App to send spam or unsolicited messages
• Post fake service requests or fraudulent bids
• Manipulate reviews or ratings
• Circumvent TrustNear's fees or payment systems

11. Intellectual Property

11.1 App Content

The App, including its design, logo, content, and functionality, is owned by TrustNear and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

11.2 User Content

By posting content (reviews, photos, messages), you grant TrustNear a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating the App.

12. Disclaimers

12.1 Service Quality

12.2 No Warranty

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Continuous, error-free operation

12.3 Third-Party Services

We do not control and are not responsible for third-party services accessed through the App (e.g., payment processors, mapping services).

13. Limitation of Liability

13.1 Damages

To the maximum extent permitted by law, TrustNear shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Damages resulting from service disputes between users
• Unauthorized access to your account
• Actions or omissions of other users

13.2 Liability Cap

Our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you have paid to TrustNear in the past 12 months, or $100 USD, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless TrustNear and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your interactions with other users

15. Dispute Resolution

15.1 Informal Resolution

Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at legal@trustnear.app.

15.2 Arbitration

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. The arbitration shall take place in Hyderabad, Telangana, India.

15.3 Class Action Waiver

You agree that any disputes will be arbitrated on an individual basis and not as part of a class action or consolidated proceeding.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action shall be brought in the courts located in Hyderabad, Telangana, India.

17. Termination

17.1 By You

You may terminate these Terms at any time by deleting your account through the App or contacting us.

17.2 By TrustNear

We may terminate or suspend your account and access to the App immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is illegal.

17.3 Survival

Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution shall survive termination.

18. Force Majeure

TrustNear shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, earthquakes, fires, strikes, or internet service provider failures.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction. Any attempted transfer in violation of this section shall be void.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrustNear regarding your use of the App and supersede all prior agreements and understandings.

23. Google Play Specific Terms

23.1 One-Time Purchase

TrustNear is free to download and use. Any future premium features will be clearly priced and require your explicit consent before purchase.

23.2 Refund Policy

For any in-app purchases (if applicable), refunds will be handled in accordance with Google Play's refund policy. Contact us within 48 hours of purchase for refund requests.

23.3 User-Generated Content

When you upload content to the App, you grant TrustNear a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display such content in connection with operating and promoting the App.
